Evidence Harvesting

At the start of the discovery process, it is difficult to know for certain which pieces of information will be critical evidence in a matter.

The review of paper documents in discovery does not alter their evidentiary value; electronic evidence, however, can be compromised simply by opening, viewing, or printing a document.

OnlineSecurity’s Forensic Evidence Harvesting Service (FEHS) provides a cost-effective compliment to traditional electronic discovery solutions to provide authenticated and admissible electronic evidence.

Service Description:

  • Working in coordination with the client’s electronic discovery vendor of choice, OnlineSecurity will harvest all evidence required for discovery using forensic software to preserve the evidentiary value of the evidence.
  • OnlineSecurity will provide copies of all files harvested to the client’s electronic discovery vendor in the manner in which this vendor requests and/or requires while ensuring the integrity of the information.
  • OnlineSecurity will securely store, for the period of twelve months, all evidence harvested, so that in the event that the information must be presented as evidence, OnlineSecurity can testify to the authenticity, integrity, and veracity of the evidence.

Delivery Mechanism:

  • Prior to harvesting, OnlineSecurity will meet with the client and the client’s electronic discovery vendor to coordinate the harvesting of evidence.
  • During harvesting, OnlineSecurity will work in conjunction with the client’s IT department to ensure no interruption of business continuity.
  • OnlineSecurity will use court accepted forensic protocols to create evidentiary copies of all the information for discovery. Working copies, to be given to the electronic discovery vendor will be made from the evidentiary copies using forensic protocols to ensure the evidentiary copies are not altered.

Deliverables:

  • OnlineSecurity will provide the copies of the harvested files to the client’s electronic discovery vendor.
  • OnlineSecurity will provide to the client and the electronic discovery vendor a detailed harvesting report encompassing systems collected, chain of custody, and observations from the forensics engineer.

Expert witness testimony is an additional service beyond the scope of the forensic evidence harvesting service and will be billed separately.
