Employer Protection Program

Litigation involving former employees typically commences six months to one year after they have left a company.  During that time period critical evidence is lost when computers are repurposed and it can be challenging, time consuming, and expensive to reconstruct this lost evidence.

OnlineSecurity’s Employer Protection Program (EPP) provides a cost-effective solution to this situation by enabling companies to preserve authenticated and admissible evidence at the time an employee leaves.

Service Description:

  • As specified by the client’s legal or human resources team, OnlineSecurity will obtain an evidentiary copy of the employees hard drive prior to or immediately after an employee leaves the company.
  • OnlineSecurity will securely store, for the period of twelve months, all evidence harvested, so that in the event that the information must be presented as evidence, OnlineSecurity can analyze the information for relevant evidence and testify to the authenticity, integrity, and veracity of that evidence.

Delivery Mechanism:

  • EPP can be delivered in two manners: as-needed and subscription based.
  • On an as-needed basis, OnlineSecurity forensics engineers will arrive at a client site within 24 to 72 hours (depending on geographic location) to capture the evidentiary copy. Once on site, they will work with the designated client representative to avoid business interruption or conflict.
  • On a subscription basis, OnlineSecurity will meet with the client’s legal and human resources teams to identify key business and technical leaders. OnlineSecurity forensics engineers will then obtain evidentiary copies of these individuals systems on fixed agreed upon schedule, i.e. every 6 months. This collection can be done covertly or overtly depending on the needs of the client.
  • OnlineSecurity will use court accepted forensic protocols to create the evidentiary copies.
  • Unless there is a legal matter, OnlineSecurity will not access the information on the evidentiary copies; unless otherwise requested, all information will be destroyed or returned to the client at the end of the 12 months.
Deliverables:
OnlineSecurity will provide to the client a detailed collection report encompassing systems collected, chain of custody, and observations from the forensics engineer.
